Who Qualifies as a PBS Dependant?

A dependant is a child, spouse/partner of the main applicant/person with a valid visa or settled person in the UK.


Requirements

To qualify as a dependant of a PBS visa holder you must be one of the following: -


1. A Spouse

2. An Unmarried partner

3. A Civil partner

4. A Child (under 18)

Dependant Visa Application
A dependant visa application can be made either outside or within the UK. Dependants may apply at the same time as the main applicant (The main applicant can include dependants at the same time on their application) or apply separately. 

Making an application within the UK means that the dependant/s are already in the UK on some form of valid leave, and they are allowed to switch.



Applying as a Spouse or Partner

To  apply as a spouse / partner under the dependant visa route you must be a spouse, unmarried partner or civil partner of a person with or applying for leave under Tier 1, 2 ,4 or 5 (of the Points Based System) or a person with British Citizenship or indefinite leave to remain in the UK . It is important to note that if you are applying as an unmarried partner, you must have lived with your partner for at least 2 years.


Applying as a Child Dependant


To apply as a child:

 - You must be a child of a person who has, or is applying for, leave under Tier 1, 2 ,4 or 5 (of the Points Based System) 

or 

 - You are a child of a person with indefinite leave to remain or British Citizenship, and your other parent does not yet qualify for indefinite leave to remain and you previously held leave as a dependant which was granted on or after 9 July 2012.


Additionally in order for the child dependant to qualify, one the following must be satisfied: -


  • both of the applicant’s parents must either be lawfully present (other than as a visitor) in the UK, or being granted entry clearance or leave to remain (other than as a visitor) at the same time as the applicant;
  • one parent must be lawfully present (other than as a visitor) in the UK and the other is being granted entry clearance or leave to remain (other than as a visitor) at the same time as the applicant, 


Exceptions

The following comprise of exceptional circumstances where a child dependant application can still be made with only one parent in the UK: 


  • The Main Applicant is the applicant’s sole surviving parent,
  • The Main Applicant is the parent that has and has had sole responsibility for the applicant’s upbringing;
  • There are serious or compelling family or other considerations which would make it desirable not to refuse the application and suitable arrangements have been made in the UK for the applicant’s care.


Personal savings / Maintenance

You must show that your dependants can be supported while they’re in the UK. Each dependant must have £630 available to them whether they apply with the main applicant or separately. This is in addition to the £945 the main applicant must have to support themselves.

You must have proof you have the money, and that it’s been in your bank account or your dependant’s bank account for at least 90 days before you or they apply.  Exceptions for proving savings are that if you have a 'A rated' sponsor, or a Certificate of Sponsorship (COS) stating your sponsor will provide each of your dependants at least £630 to cover their costs for a month should they need it.


How Much is the Dependant Visa Fee?

The Fees of the Dependant visa are subject/linked to the type of visa the main applicant currently holds (or will be applying for).  The cost per applicant are currently set out as below:


Dependants of Tier 1 (Exceptional Talent) - £1,021 applying outside the UK, £608 applying inside UK


Dependants of Tier 2 General Workers (Visa Up to 3 Years) - £610  applying outside UK, £704 applying inside UK

Dependants of Tier 2 General Workers (Visa Up to 3 Years - Shortage Occupation) - £464 applying both outside and inside UK

Dependants of Tier 2 General Workers (Visa More than 3 Years) -  £1,220 applying outside UK, £1408 applying inside UK

Dependants of Tier 2 General Workers (Visa More than 3 Years - Shortage Occupation) -  £928 applying both outside and inside UK


Dependants of Tier 4 Student Visa Holder - £348 applying outside UK, £475 inside UK


Dependants of Innovator Visa Holder - £1,021 applying outside UK, £1,277 applying inside UK


Dependants of Start-up Visa Holder - £363 applying outside the UK, £438 applying inside the UK


Healthcare Surcharge

The Immigration Health Surcharge (IHS) is also applicable to dependants and costs £400 per year, the total amount (e.g. £1200 for a 3 year visa) of which must be paid at the time of making the visa application.


How Long can a PBS Dependant Stay in the UK?

The period of leave granted to a PBS dependant will be in line with the period remaining ( up to the expiry date) on the visa of the main applicant/PBS Visa holder.  The exception is where indefinite leave to remain has been granted to the main applicant, in which case the dependant will be granted a period of 3 years.
